Terms and Conditions for N@U Limited - N@Skills Services

By purchasing, subscribing to, or accessing any N@Skills or N@U Limited online offerings (collectively referred to as the 'Services'), you agree to these Terms and Conditions ('Terms'). These Terms apply to all online products, learning tools, and subscription-based resources provided by N@U Limited. If you do not agree to these Terms, please refrain from using our Services.
1. General Information
The Services are designed to provide skills-based learning, resources, and insights into neurodiversity and academic development. All materials are provided for educational purposes only. While we aim to offer accurate and helpful information, our Services are not a substitute for professional medical or psychological advice.
2. Eligibility
You must be at least 18 years old or have the consent of a legal guardian to enrol in or use the Services. By enrolling, you confirm that you meet this requirement.
3. Consumer Rights
Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986, where these laws apply. If you are located outside New Zealand, your local consumer protection laws may also apply.
4. Pricing and Payment
All prices are listed in New Zealand dollars (NZD) and are subject to 15% Goods and Services Tax (GST) unless otherwise stated. Payments are processed securely through our payment provider.
5. Service Access and Use
Upon payment and registration, you will receive access to the Services for the duration of your subscription or purchase. Access is non-transferable. You are granted a limited, non-exclusive, non-transferable licence to access and view the materials for personal, educational use only. You agree not to share, reproduce, distribute, or sell Service materials without written consent from N@U Limited.
6. User Responsibilities
You are responsible for maintaining the confidentiality of your account details and for all activity under your account. You agree not to reproduce, distribute, or share Service materials without permission, use the Services for any unlawful or fraudulent purposes, or attempt to reverse-engineer any part of the platform.
7. Intellectual Property
All content within the Services, including text, images, videos, audio, and digital materials, is owned by N@U Limited and protected by intellectual property laws. You may not use or distribute content outside of personal educational purposes without written consent.
8. Privacy and Data Protection
Your personal information is managed in accordance with our Privacy Policy. By enrolling in or using our Services, you consent to the collection and use of your personal data for Service-related purposes.
9. Refund Policy
If you are dissatisfied with the Services, you may request a refund within seven (7) days of purchase, provided you have not completed more than 30% of the content. Refunds will be processed in accordance with the Consumer Guarantees Act 1993, where applicable. Refunds are not available for change of mind once significant content has been accessed. Approved refunds will be processed within 10 business days of confirmation.
10. Termination of Access
N@U Limited reserves the right to suspend or terminate access for non-payment, breach of these Terms, or misuse of the Services. Users will be notified of any suspension or termination.
11. Third-Party Services
Our Services may link to or use third-party platforms, such as Kit (email management) or Stripe (payment processing). These are governed by their own terms and privacy policies.
12. Limitation of Liability
To the extent permitted by law, N@U Limited is not liable for any indirect, incidental, consequential, or special damages arising from your use of the Services. Our total liability for any claim will not exceed the amount paid for the Services. You are responsible for how you apply any advice or information provided.
13. Health Disclaimer
The Services may reference general information about neurodiversity, learning, and wellbeing. This information is not a substitute for professional medical advice. Always seek advice from a qualified healthcare provider regarding health-related concerns.
14. Behaviour and Conduct
You agree to conduct yourself respectfully within all parts of the Services. Harassment, abuse, or inappropriate behaviour may result in termination of access without refund.
15. Dispute Resolution
If you have a concern or dispute, please contact us first so we can seek to resolve it informally before any formal proceedings.
16. Amendments
N@U Limited reserves the right to modify these Terms at any time. Updates will be communicated through email or our website. Continued use after changes indicates acceptance.
17. Governing Law
These Terms are governed by the laws of Aotearoa New Zealand. Any disputes shall be resolved in the New Zealand courts. International users are responsible for ensuring compliance with local laws.
